Terms of Use
These terms govern your use of the Mellow app and this website. Please read them — a few of them matter a great deal for your safety.
These terms are a plain-language draft. Items marked TODO must be completed, and the whole document reviewed by qualified counsel, before Mellow is offered to the public. We have not invented liability, warranty or jurisdictional commitments.
1. Agreement
By using Mellow, you agree to these terms. If you do not agree, do not use Mellow. TODO The identity of the contracting party must be stated here.
2. What Mellow is
Mellow is a personal drinking companion. It helps you log drinks, follow how a night is going, and — after enough logged nights — see patterns in how you tend to drink.
3. What Mellow is not
This section is the most important one in these terms.
- Mellow is not a breathalyzer. It does not measure alcohol in your body. It does not read your breath, your blood or your physiology.
- Mellow is not a medical device and does not provide medical advice, diagnosis or treatment. Nothing in Mellow is a substitute for advice from a qualified health professional.
- Mellow must never be used to decide whether it is safe to drive or to operate machinery, or to decide whether you have sobered up.
- Mellow does not tell you how much you can drink. Nothing in Mellow should be read as encouragement to drink more, faster, or at all.
Mellow provides estimates based on what you log. It is not a breathalyzer and should never be used to decide whether it is safe to drive. Never rely on any app, including this one, for a decision about driving or safety.
4. Accuracy of estimates
Every reading Mellow shows is an estimate derived from what you chose to log. Estimates can be wrong, incomplete, or unavailable. Where Mellow is unsure, it will say so rather than guess. Judgements Mellow makes about your drinking style are tendencies observed in the nights you logged — they are not statements about you as a person.
5. Responsible and lawful use
- You must be of legal drinking age in your jurisdiction to use Mellow.
- You must use Mellow in accordance with the laws that apply to you.
- Mellow is a personal companion. It is not a tool for monitoring, policing, or judging another person's drinking.
TODO The minimum age to state here must be confirmed against the App Store age rating and the operating entity's jurisdiction.
6. Your account and your data
Your use of Mellow is also governed by our Privacy Policy, which describes what Mellow collects and how you can delete it. What you log is yours. You are responsible for keeping your device secure.
7. Subscriptions
Mellow Premium is not on sale yet. This page does not sell anything today.
- Subscriptions, when offered, are purchased through the App Store and are managed by Apple, not by Mellow.
- Payment is charged to your App Store account at confirmation of purchase.
- A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
- You can manage or cancel a subscription in your App Store account settings. Deleting the app does not cancel a subscription.
- Free features are not time-limited and do not expire into a locked state.
TODO Refund policy wording, trial terms if any, and the complete auto-renewal disclosure must be finalised with the actual StoreKit products before submission.
8. Acceptable use
You agree not to:
- Reverse engineer, scrape, or attempt to extract Mellow's models or recognition data;
- Abuse the recognition service, including by automating requests or circumventing usage limits;
- Upload content you do not have the right to upload, or any unlawful content;
- Use Mellow in a way that breaks applicable law.
9. Availability and changes
Mellow is under active development. Features may change, and photo recognition or other online features may be unavailable at times. We do not promise uninterrupted availability.
10. Disclaimers and limitation of liability
Mellow is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Mellow is provided without warranties of any kind, and Mellow is not liable for decisions you make about drinking, driving, or your health.
TODO The full warranty disclaimer and limitation-of-liability clause, together with any consumer-law carve-outs applicable in your jurisdiction, must be drafted and reviewed by qualified counsel. This draft deliberately does not invent those commitments.
11. Termination
You may stop using Mellow at any time and delete your data as described in Delete your account and your data.
12. Governing law
TODO The governing law and the courts with jurisdiction must be confirmed by the operating entity.
